You can't just go around imprisoning or deporting people without trial, when they haven't even been charged with, let alone convicted of, a crime.

If he could be deported to a country with a satisfactory record on human rights, where he would be assured of a fair trial (and if convicted, incarceration in humane conditions), then sure - but El Salvador is not such a country, and so the US is obliged to not return him there.
Similarly, European countries will never extradite anyone to the US, if they would face the death penalty, because that's not considered an acceptable form of punishment in this day and age.
