A federal judge Wednesday barred the Trump administration from immediately taking Kilmar Abrego Garcia into custody should he be released from pretrial incarceration on immigrant smuggling charges.

Abrego Garcia, who was wrongly removed from the U. S. earlier this year and imprisoned in El Salvador, must be returned to Maryland from Tennessee on an order of supervision, the judge also ruled.

That’s a pretty sound ruling on the judge’s part… If there’s one thing smugglers don’t do it’s move things and people over borders. Certainly no flight risk here.

Yes, the problem with that is that since the Supreme Court ruled in the DHS's favor, the judge that made the ruling in Maryland has no jurisdiction in Tennessee. ICE will take custody of this fine Maryland father and before he knows it, he will be winging his way back to El Salvador.

Federal judges do not have jurisdiction only in the state where they are. Federal judges can preside over cases that fall under the jurisdiction of the federal court system, which is not limited by state boundaries. They can hear cases involving federal law, disputes between citizens of different states, or cases involving the U. S. government.

@exitseven The judge has jurisdiction for a specific case, they just can't make a nation wide injunction for ALL cases that are similar in nature. That was my understanding of the Supreme court ruling. In other words, she can say ice can't immediately deport Garcia without due process and 72 hrs warning but her ruling is limited to his case only. In the past, they would rule that all illegal immigrants released from custody while awaiting trial, can't be detained by ice and be deported. Now, each specific case needs a separate ruling.

@Beckybooboo that is correct. A Maryland judge cannot make a ruling that is valid throughout the entire country. This was the law and the Supreme Court has recently re-inforced this. The Maryland judge cannot rule on an issue in Tennesee.

It's a Maryland case and Garcia is in federal custody in Tennessee, she has full jurisdiction. I'm not saying it's right or wrong, I'm just saying she's not making a state ruling, she's making a federal ruling.

I should also add, she's only saying he can't be IMMEDIATELY detained for deportation. I think he and his lawyers need 72 hrs notice, so, technically, she has no justification over ice eventually deporting him.
