Yesterday a judge ordered the government to allow Venezuelan men who were removed from the U. S. earlier this year to challenge their ongoing imprisonment in El Salvador, saying the Trump administration attempted to create “a legal no man’s land.”

@goaded The fact the judges are all democrats could be a factor? It has been shown that no other president had any problem with deportations. This is lawfare plain and simple. Trump is taking the high road by passing legislation to change the law instead of ignoring an obvious attempt by democrats to sabotage his policies.
I bet that if he went in front of the American people and explained that he would bee ignoring these rulings and what the reasons are, the vast majority of the country would be behind him.

It only takes Congress to create a law denying this then the courts can itself challenge this but the likelihood of it being reversed is likely zero as they are not citizens.

Congress can technically make laws that are later deemed unconstitutional by the Supreme Court. While Congress has the power to legislate, the Supreme Court has the power of judicial review, meaning it can declare laws passed by Congress to be unconstitutional if they conflict with the Constitution. Since many legislators are also lawyers, there is no way Congress would ever pass a law such as the one (s) you are adocating.
