If someone plants the tree right in the middle of the road I think we have a case, because whether or not one was speeding the tree is in a dangerous spot.

In light of the fact that people might crash into trees, trees should be banned from streets, parkways, and front yards just like deer should be banned from crossing roads in places that aren't marked "deer xing". Our priority should be preventing damage to motor vehicles and harm to people who don't know how to drive.

Another options is to require all trees to have collision and liability insurance.

LOL. That's an assumed risk of driving. If they placed a hazard in the roadway, then they would be liable.
