I am talking about the US sailors who assisted in blowing up and killing innocent fishermen in the Caribbean by firing missiles at them, and in doing do failed to refuse illegal orders.

The UCMJ* imposes a duty to refuse illegal orders. Service members are required to disobey an order that is "manifestly unlawful". An order is considered unlawful if it violates the Constitution, U. S. laws, international law, or military regulations, or if it directs a service member to commit a crime. Disobeying such an order is not a violation of the UCMJ and is protected, whereas obeying one can lead to criminal liability for the service member.

Yes, they are now criminals. You swear an oath to uphold the laws and the Constitution, NOT your superior officers IF they give you orders that violate any of the above mentioned governing bodies. Trump has already violated several of those laws, yet no one in authority in the military has had the fucking balls to arrest him for it.

The ones who WOULD have were replaced as quickly as he got into office. I don't support attacking vessels which aren't a direct threat without making any attempt to detain them but "innocent fishermen" with ton of fuel and four 150hp engine is a gullible assumption.

There is no evidence of the presence of "a ton of fuel". As a sailor myself, I can tell you that those boats are far too small to have made the 1000+ mile trip to the shore of the US. All that you get with four engines like that is increased fuel usage and dcreased range. Speed i limited bu hull shape and sea state.

It's not up to them to determine what's legal and illegal when they're following orders.

That's incorrect. If they think that the order that they are receiving is illegal, they are obligated under the universal code of military Justice to refuse that order. There is nobody else to determine whether or not the order is legal or illegal. The person that receives the order has to determine that.
