Did these men become criminals too?

I am talking about the US sailors who assisted in blowing up and killing innocent fishermen in the Caribbean by firing missiles at them, and in doing do failed to refuse illegal orders.

The UCMJ* imposes a duty to refuse illegal orders. Service members are required to disobey an order that is "manifestly unlawful". An order is considered unlawful if it violates the Constitution, U. S. laws, international law, or military regulations, or if it directs a service member to commit a crime. Disobeying such an order is not a violation of the UCMJ and is protected, whereas obeying one can lead to criminal liability for the service member.
