Why even have a jury?

A judge can set aside a jury's verdict if they want to. So, what's the point of a jury if the judge doesn't have to agree with or abide by their decision?

A jury and a judge don’t have the same job, and that’s the key to understanding this.

The jury decides the facts. They listen to the evidence, watch the witnesses, and decide what actually happened and whether the case was proven. The judge’s role is different. The judge makes sure the law is followed and that the trial itself is fair and legal.

Yes, a judge can set aside a jury’s verdict, but this is not a matter of personal disagreement. A judge can’t just say “I don’t like the jury’s decision.” That power is used only in rare and extreme situations, like when no reasonable jury could have reached that verdict based on the evidence, when the verdict clearly violates the law, or when there was a serious legal error that made the trial unfair.

Think of it like this. The jury is watching the game on the field and calling what they see. The judge is there to make sure the rules of the game weren’t broken. The judge only steps in if something went fundamentally wrong, not just because the call was unpopular.

Historically, this balance exists to protect people. Juries were created so regular citizens, not government officials, decide guilt or liability. Judges were given limited override power to prevent mob justice, political pressure, or verdicts that flat out break the law. Both sides act as a check on the other.

In practice, most jury verdicts stand. Judges defer heavily to juries, especially on questions of credibility and facts. If judges could freely ignore juries, higher courts would overturn those decisions quickly.

So the jury absolutely matters. It is not a suggestion. It is the core of the system. The judge’s ability to step in is a rare safety net, not a veto button.

Judges will very, very rarely set aside a jury verdict, and they only do so after a lot of consideration and with very sound legal reasoning.
