@DishLady Free speech (the First Amendment to the US Constitution) prevents anyone from stopping you from saying whatever you want. It does not protect you from any consequences of what you say

@AviatorTom and @OlderAndWiser I'm not denying what you're saying to be true, but look around at the TON of lawsuits for slander and libel. Look at all the newspaper and social media retractions. Look at all the reporting, etc.

There are limits, even in a democratic republic, going way back to the time of Socrates...

Yes, the limits are that you can have liability for intentionally misrepresenting facts. If you tell people that I was once a member of the Community Party, you are liable for presenting a false fact. But if you say that you think I act like a communist, you are not liable because that is your opinion (but my feelings will be hurt.)

Friendly reminder though, encroaching on another person's rights via your speech is not a form of protected free speech. That's why, in many states, certain expletives and acts are not covered under free speech and are arrestable offenses.

@MicahRaine I strongly suspect that any statute that criminalizes a person saying a racial epithet would be deemed unconstitutional. What most people do not consider is that speech acceptable to the majority does not need legal protection; it is the unpopular ideas that need the First Amendment protections.. But that system protects all of us because, if our "free speech" depends on satisfying some appointed censor, our speecg is free only if the censor approves of us.

My uneducated guess is that it likely depends on each state or county. If the state/county deems racial slurs to be a form of harassment, it would not be a protected form of free speech. Many states also classify public profanity as a misdemeanor offence, I believe.

@MicahRaine No, your guess is absolutely wrong. Free speech is protected by the First Amendment of the US Constitution. Any state law which tries to abridge the rights guaranteed by the Constitution is void and unenforceable. Any state which passes such a law will have the law challenged and declared unconstitutional.

If a black person wants to call me "Honky," it is disrespectful but they have the right to do that, However - of course - having the legal right to do something doesn't make it the right thing to do.
