Presumably yes. If the gmail TOS states that the user is not allowed to share the account, then potentially the other user is technically not authorized. And accessing a computer system to which you are not authorized to use would be violating the Federal Computer Fraud and Abuse Act.

Hacking crimes tend to not get prosecuted. But the laws are so ill-defined that the State can really fuck you over with them if you make yourself an enemy of them.

Opening someone's paper mail is a federal offense. Reading someone's e mail is an invasion of privacy, but would be difficult to prove since she gave you her password.
