Yes, but that has to be proven in a court of law first. However, as it stands the immigration courts are so backed up jails can't legally hold them until their court dates, so they have to release them. The senate republicans worked with democrats to come up with a solution to this: hire thousands of new immigration judges.

Unfortunately, trump had republicans kill their own border bill by whining he would have nothing to campaign on if it passed. Which only shows how little you people actually care about it.
