11 moEvery country has a path to citizenship & unfortunately there are people out there who take the wrong path & enter those & this country illegally & if you are in volition bye bye.
As for people demonstrating there is nothing wrong with a demonstration however when a demonstration turn into a riot where property is getting destroyed or people are using a demonstration or riot to go shopping for free (looting) those individuals should be prosecuted with a minimum of five years in jail if you are a citizen & if you are not a citizen bye bye, back over the fence you go.

Asker11 moI think we are all tired of thd constant protests. There has to be a limit. As soon as spring starts all of a sudden its protest festival time and these protestors move from protest to protest and ordinary people can't get to work, can't ho shopping can't pick up their kids

11 moSo if trump passes and the Democrats take control and go after your guns... And use the military and you resist, you should be deported for protecting what is right? They will call you domestic terrorist with firearms! Should you be deported? I would say no you need the opportunity to defend yourselves. Would you want the libs to say they have guns they deserve it, terrorists? Why can't they just turn them? They are illegal domestic terrorist. the president has said the second amendment doesn't apply except to those that serve in the military? It has all become so easy to say screw the laws when we think it's never going to bite us in the ass. But it always does.

Asker11 moDemocrats won't ho after guns because a large amount of Democrat voters have guns. Also they won't come after the guns, they will just make it illegal so that if you are caught with an ilegal firearm then it's jail. It's the same reason nobody has full auto guns whereas in the past they were widely available to buy.
The gun industry was very useful to the Democrats in supporting the war in Ukraine, Ukraine was able to buy off the shelf AR15s and gun accessories along with body armour by the hundreds of thousands. The gun industry is a big part of the industrial military complex.- 11 mo
Yes I am sure liberals said the same thing about abortions. I like the cynicism but my example is just doing something clearly outside of rule of law because your base likes it and it extends your control over the population as whole without as big an argument. But if you think the firearm industry would stop a charismatic authoritarian leader from taking our guns away... think again.
Asker11 moYou can still get abortions.
449 opinions shared on Trending & News topic. How do you know they are all illegals?
To know that, you'd actually have to arrest them first then determine if they were illegal.
But you know what an illegal alien doesn't do?
Protest.
Why?
Because they don't want to get arrested and deported.
So, that means who is likely left doing the protesting are what the government calls "US Persons"; people here legally.
You are young so I will cut you some slack, but you didn't think this through very well. Part of that is that your youth disables you from thinking more deeply but also your youth means you aren't very smart about human nature. Knowing human nature is a pivotal skill toward being a good thinker about humans and is a survival skill.
Meanwhile, I leave you with this old adage said a dozen different ways:

You know how we can know they are illegals?
8 U. S. Code § 1481 - Loss of nationality by native-born or naturalized citizen; voluntary action; burden of proof; presumptions
(a) A person who is a national of the United States whether by birth or naturalization, shall lose his nationality by voluntarily performing any of the following acts with the intention of relinquishing United States nationality—
7) committing any act of treason against, or attempting by force to overthrow, or bearing arms against, the United States, violating or conspiring to violate any of the provisions of section 2383 of title 18, or willfully performing any act in violation of section 2385 of title 18, or violating section 2384 of title 18 by engaging in a conspiracy to overthrow, put down, or to destroy by force the Government of the United States, or to levy war against them, if and when he is convicted thereof by a court martial or by a court of competent jurisdiction.
Your boys attacked federal agents and federal buildings... - 11 mo
@contentious First...
Major kudos for citing United States Code!
Second, they are not "my boys".
That said:
1. Treason is defined in the Constitution and that is the only legal definition that holds.
ARTICLE III
SECTION 3
Clause 1
Section 3.
Treason against the United States, shall consist only in levying war against them, or in adhering to their enemies, giving them aid and comfort.
That is echoed in 18 U. S. Code § 2381 - Treason.
Whoever, owing allegiance to the United States, levies war against them or adheres to their enemies, giving them aid and comfort within the United States or elsewhere, is guilty of treason and shall suffer death, or shall be imprisoned not less than five years and fined under this title but not less than $10,000; and shall be incapable of holding any office under the United States.
The penalty for treason under 18 U. S. Code § 2381 does not include losing citizenship.
2. The statute you cited references 3 statutes in Title 18. I know these statutes due to J6.
18 USC §2383 - Rebellion or insurrection
18 USC §2384 - Seditious conspiracy
18 USC §2385 - Advocating overthrow of Government
However, I am not sure that any of them apply, although §2383 might.
§2384 involves deliberate coördinated planning involving multiple people (that's why it's conspiracy).
§2385 is out because there is no "overthrow of government" being advocated.
(more) - 11 mo
So, this just leaves §2383 which is a simple statute:
Whoever incites, sets on foot, assists, or engages in any rebellion or insurrection against the authority of the United States or the laws thereof, or gives aid or comfort thereto, shall be fined under this title or imprisoned not more than ten years, or both; and shall be incapable of holding any office under the United States.
= = = = =
This might be applicable to some rioters, but I wouldn't necessarily say that. At the same time, it wouldn't surprise me.
However, 8 U. S. Code § 1481 as you cited has an important statement right at the beginning...
"... with the intention of relinquishing United States nationality."
So, to convict under this statute, you need to show motive that the person committing the act had the intention of relinquishing nationality. You're not make a conviction on that. (Otherwise, pretty much ever J6 rioter would have been charged with this.) Instead, the charge you need to cite is obstruction; basically the same statutes that many J6 rioters were charged (or convicted) of violating... (I think 18 USC §2383 was included in some charges.)
For example:
18 USC § 1511. Obstruction of State or local law enforcement
Bottom line: Rioting doesn't lead to losing citizenship and, even if it did, you need due process. It's not automatic. - 11 mo
Now try reading past the first comma.
- 11 mo
You tried to act smart, but failed to read what was posted. For example section 2383 of title 18 specifically speaks to rebellion and insurrection. Rebellion and insurrection apply when perpetrators destroy government property or assault federal officers. That clearly was the context of what I posted, but you ran away for the position to try to hide from the truth.
- 11 mo

- 11 mo
@contentious I did read past the 1st comma. You need to understand the law better and it is obvious that you don't. Your interpretation of the statute would be that anyone who violated a federal law immediately loses their citizenship... and apparently without due process which even the conservative SCOTUS recently said was unacceptable.
- 11 mo
No, that's your projection of your interpretation and your lack of understand of the law. I specifically referenced section 2383 of title 18 which specifically speaks to rebellion and insurrection. Rebellion and insurrection apply when perpetrators destroy government property or assault federal officers. Your socialist comrades, have attacked federal officers, set ICE vehicles on fire, attacked federal buildings as a concerted conspiracy to over throw the authority of the federal government by force. Thus under 8 U. S. Code § 1481 they have voluntary forfeited their citizenship and can be tried by court martial and legally stripped of that privileged and then be deported in violation of immigration laws.
- 11 mo
At this point they can be treated as enemy combatants being that they have supported or participated in terrorist activities against the United States and the U. S. military has the authority to detain them indefinitely and without charge if they please. Due process can go right out the window.
- 11 mo
I don't really think you're getting it... The Alien Enemies Act has been invoked regarding the "invasion of The United States by Tren De Aragua" and your buddies are aiding a foreign army that is at war with the United States.
- 11 mo
The insurrection act allows the president to use the military to enforce federal law or suppress a rebellion against federal authority in a state. Why do you think the Marines are being deployed in California? A rebellion that has used force to overthrow federal authority which is aiding a foreign enemy is underway. You're under military law now. Your people went to war with the US government.
- 11 mo
Since you are kind of you slow I will put it in plain English. The Democrats have started another "CIVIL WAR". They aren't littering on the street or jaywalking and waiting to get a slap on the wrist, they have used force to overthrow the authority of the United States government. They can be detained and held without charge indefinitely until the end of hostilities however long that may be. Then they can face trial by military commission. They can be stripped of their citizenship for partaking in a rebellion and they can be deported. They are illegals. They like you just don't know what they've signed on for yet. You don't understand the gravity of going to war with the United States government... The Civil War was called a rebellion by the people that actually fought the war because legally that is what it is. The Democrats have repeated the same mistake, although it is in it's infancy. Yet in 2 days they plan to expand their campaign all across the nation on June 14th.
- 11 mo
Since you don't seem to understand how rebellion applies, fine can agree that you are incapable of understanding what the term rebellion means. None the less troops have been deployed under 10 U. S. C. § 12406.
Whenever--
(1) the United States, or any of the Commonwealths or possessions, is invaded or is in danger of invasion by a foreign nation;
(2) there is a rebellion or danger of a rebellion against the authority of the Government of the United States; or
(3) the President is unable with the regular forces to execute the laws of the United States;
the President may call into Federal service members and units of the National Guard of any State in such numbers as he considers necessary to repel the invasion, suppress the rebellion, or execute those laws. Orders for these purposes shall be issued through the governors of the States or, in the case of the District of Columbia, through the commanding general of the National Guard of the District of Columbia. - 11 mo

Black’s Law Dictionary
rebellion. 1. Open, organized, and armed resistance to an established government or ruler. 2. Open resistance or opposition to an authority or tradition. 3. Hist. Disobedience of a legal command or summons.
Are your boys openly saying the oppose ICE raids? Are they organizing? Are they resisting the authority of the established government? Are they calling to shoot ICE agents? Are they attacking federal officers, federal vehicles, federal buildings? Are troops being federalized to protected against such actions to maintain the authority of the federal government?

Arrest the rioters and I guarantee most of them aren't illegal immigrants. Illegal immigrants don't want to get arrested and deported, or fired when they don't show up to work. These people have the privilege of being able to go home in the US after they get out of jail. I do think any "protestor" who causes violence or property damage should go to jail.
