Why would you talk to an incarcerated person to begin with. They are obviously not a good person and could some day get you in trouble some day.
I would not see a family member of a criminal. That is just not something I would risk. You don't know the untold with a family like that.
I would say it depends how serious things are with the incarcerated guy. If you're just friends, there shouldn't be anything stopping from you from having a relationship with the brother if you like him. On the other hand, if things are serious with the incarcerated guy, it's kind of a red flag that his brother is hitting on you.
He wouldn't have tried unless he thought he had a chance. Shut it down and move on.
Go for it if you like the brother more
Have some self-respect.
