Best to find another job and leave. I have worked for two managers over the years who were "borderline toxic". The first one, when I caught on to it, I started looking for another job that I thought would be better. It took me about 6 months, but I left when I landed a new job. The next guy who I worked with was also borderline toxic but it wasn't as bad as the other one and also the job was better, so I stayed. He eventually moved to be closer to the district office, only to ruin his reputation there when they found out he was an ass.

As far as suing them? Depends how pervasive his/her toxicity is in the workplace. If you think you have grounds for a lawsuit, consult a lawyer.
