Fedex lost my package?

So I ordered some tires for my trailer off of ebay and noticed they never showed up, but someone had signed for them. They didn't even spell my name right I think the driver just signed the pad himself. I know the ups driver does that if I have a signature required package, but he knows who I am and where I live. Anyways, am I fucked now since it was signed for and now it appears that I'm trying to rip them off? The ebay seller is just saying well it shows you signed for the package. Opinions?

Contact that Fedex driver. Ask for a pickup and then when he shows up ask him! Very strange thing to steal. Then get a police report.
