Person who gifted me with a car now wants it back?

What do I do? This person gave me a car 8 years ago for free. She was moving to China and didn't want it anymore. Now she's moved back... my parents have paid the insurance for 8 years and updated the tires, stereo and given it all its check ups. She wants it back, for free. Is that fair? She GAVE it to me as a gift! Can you take back such an expensive gift for free?

The title is ours, not hers, the car has been in no way connected with her name for 8 years. We've replaced the tires, paid for all of the updates, oil changes etc. WTF.

Did she say you could take care of it for her while she was gone? or like...what was the specifics of the "gift"? I suppose if it is legally yours...like in your name and stuff, there is no way that she could take it back. also, if you had it in writing that she gave you the car or if you have paperwork supporting that, then if she tried to take you to court over it, you have evidence backing up your claim to it.

yeah, she legally passed the title onto us. we've paid the insurance for 8 years, replaced the tires... it is in no way her car and has not been for 8 years! I am so pissed.

yeah, I'd feel lucky that she gave it in the first place...but her act of kindness is no reason for you to feel obligated to give it back. it was a gift...and a gift doesn't require an action in response.

I don't think so, if she gave it to you she shouldn't be taking it back, ESPECIALLY since youve tuned it up and fixed the quirks of it. Tell her to go to hell, just cause she left to another country and came back years later expecting her car to be handed back to her after youve had it for so long. I would NOT give it back. Tell her sorry.

I so agree! My parents just don't want to deal with her, so they think they will give it back. FOR FREE. I've been driving that car for 8 years, I graduate next year and then the car would be mine!

Take it to court if you have too.. Have all the insurance billing statement at hand. To ensure that your parents paid for the car insurance.

Who is she to come and demand the car back. Doesn't she know once you give someone a gift, let it be small or big.. It's not hers anymore.
