+1 yThere's a broad definition of rape being used. A 16 yr old having sex with their 15yr old partner (age of consent in UK16) technically rape, but is death appropriate?
Obviously, an adult sleeping with kids under 13, someone forcably having sex with someone against their will are easier cases to judge, and they should be remoced from circulation in society.
How bout cases where drink is invovled? The was a case with a footballer Chad Evans. He slept with someone who was very drunk. Was convicted of rape but had his sentence quashed and was found not guilty on retrail. If he had been executed after his initital conviction, would that have justice? (In that case the "victim hadn't actual made a complaint as far as i know. She went to report a lost handbag after a boozy night out and the police convinced her that they should investigate as a rape case)00 Reply

We need to be careful with the word "rape" these days, because of a lot of false accusations.
If there's proof beyond any doubt, then life in prison
If it's against a child, then torture... (Unfortunately torture is illegal, but this is like top evil)
If there is remotely any doubt, then just some years in prison or release on probation.

If a man and a woman are both intoxicated, both consent to have have sex, than the next day the woman regrets the actions; would you consider her to have been unable to give consent due to intoxication and have the man charged with rape? (This is the current law in California).

How intoxicated? You can drive with a blood alcohol up to 0.85, at what blood alcohol number do we say you cannot consent to sex? How is one party to know what the other person's blood alcohol content is? What if they are both intoxicated, can they both claim they raped each other?

Really? So you meet a girl in a bar, both get drunk, have consensual sex, but the next morning she "remembers" she has a boyfriend/husband and regrets her actions, so she reports you for "rape". Now you are facing the death penalty?

Why do people in these situations always have to take these cases to the extreme? It's like when people use that similar argument towards pro choice for abortions. As crappy as our justice system is they even have different categories for rape. I mean intentional rape with proof.

because the extreme cases will invariably exist and probably be rather common. A camera doesn't follow every person's existence around you know? These things are extremely difficult to definitively prove in the best of times.
A lot of women are into rough sex now. So a woman could well consent to rough sex. And then allege something. How does the evidence look since she might have some bruises?
You may want brutal retribution for such a heinous crime, but it isn't practicable in the real world.
