Neither- it's just pragmatism. Doctors don't refuse these procedures out of sexism, but out of fear of lawsuits- neither is reversible with complete reliability. It's not a matter of law, and if it were to become one, would be a question of compelling the doctor to perform it, rather than forbidding it to the prospective patient.
