If they start making drunk drivers have a mandatory one year in prison term for DUI and if they kill someone then it be murder charge?

Usually if there is a death involved the charge becomes vehicular manslaughter. It carries a hefty jail sentence if they are found guilty. This is where being able to afford a good lawyer come sin handy.

DUI is a tough one. Drunk driving and maybe driving the next day with alcohol in your system is not the same I think.
