You can't just subpoena stuff for no reason. They're protecting his constitutional rights.

The government can't just say "I need this" and completely disregard due process and all the other laws around their actions.

They keep coming up empty handed so it makes sense that the courts would begin to raise the bar of evidence as more of these attempts come up with nothing.
