The ATF like almost all other "Federal Law Enforcement Agencies" has no place in the 11 page Federal Constitutions of 1787.

The ATF unlike most of them is not merely unauthorized by omission (10th Amendment) but explicit prohibition of the 2nd amendment which provides for no written exceptions of any kind.

As such the ATF like the FBI must honor their oath and be completely abolished. Until that day comes every oath taking branch and level of goverment must do all they can in refusing to cooperate.

* Any congressman who votes even a penny towards their support has voted in disregard of their oath and should be held accountable for that.
* Just as any federal executive that so orders them to enforce any act that so abridges the right of the people to keep and bare arms should be held accountable.
* Likewise any state or local officials who cooperates a and lends their many ages to the support of the few AFT agents is likewise accountable.

There are legitimate ways to control guns via state law. Federal law if forbidden all together from such areas.

923(g)(4) of title 18, United States Code states:

(4) Where a firearms or ammunition business is discontinued and succeeded by a new licensee, the records required to be kept by this chapter shall appropriately reflect such facts and shall be delivered to the successor. Where discontinuance of the business is absolute, such records shall be delivered within thirty days after the business discontinuance to the Attorney General. However, where State law or local ordinance requires the delivery of records to other responsible authority, the Attorney General may arrange for the delivery of such records to such other responsible authority.

They want to strike the 2nd and 3rd sentences according to the bill.

Records are still kept and the Attorney General can still inspect them... I don't know that it would dismantle ATF’s record keeping, but it's a start I suppose.

The United States Supreme Court does.

I am somewhat ambivalent about what he wants though.

He's just a blow-hard trying to drum up MAGA support for his re-election.

Shit like this happens all the time everywhere. For instance, there's always some upstate NY politician who proposes legislation to have NY split up into two states; upstate or "Upper New York" and downstate "New York". Why does this guy do this? Because his electorate feels they are "overtaxed and that all their money is going to NYC to keep those lazy welfare recipients and those liberal Democrat programs going." Of course, that electorate doesn't realize that the taxes NYC collects is actually supporting them! So, in reality, the upstate politicians know that seceding from NYC is the worst thing for them - but bitching about NYC is how you get votes...

Well, Congressman Cloud is doing the same thing. He riles up his electorate and authors a bill that won't get passed. So, he will have failed, but he lets his electorate know "I stood up ya, but the liberal swamp in Washington wouldn't have it!"

OK, so, here's what's really important:

If he GENUINELY believed what he was saying in his bill, he wouldn't bother with a bill at all. Instead, he'd file a lawsuit in the United States District Court for the District of Columbia that the ATF's database was an unconstitutional violation of the right to privacy.

Of course, the moment he uses a "right to privacy", he gets into trouble because that's what abortion was about in Roe v. Wade: A woman's right to privacy regarding the early part of her pregnancy. So, Conservatives need a "right to privacy" to not exist unless it's explicitly in the Constitution. There IS no explicit right to privacy in the US Constitution though; it's inferred through the 10th Amendment. Good luck with that; THIS Supreme Court doesn't believe in the individual right to privacy; instead, they are giving the states all the power in the 10th Amendment and the people none.

Anyway, I am getting off on a tangent.

Bottom line:

1. If Cloud genuinely believed what he did, then he'd go to Federal District Court and sue the ATF.

2. But he won't do that because he'd lost but, more importantly, his real goal is to drum up votes back home so he can be re-elected.

That would be a good start but it lacks penalties. After passage, it should be 10 years in prison for anyone working for the ATF to have such records on their computer, in their office, or at their home. Or anywhere else, under their control. Abolishing the ATF would be even better.

Honestly, yes I do. In my opinion, the whole ATF organization needs to be dismantled and completely redone.
