Well, it's the Guardian, which puts it in a rather political light in the first place, and opens with a picture of a BLM protestor; what the HELL people expect the UK government to do about police brutality in another country (um, they DO know that we're a different country now, right? We had two wars over this, and neither ended well for them...)?

Beyond that, the article specifically says "growing awareness of hate crime is likely to have led to better identification of such offences", which- odd grammar aside- indicates that you're going to see a lot more cases labeled "hate crimes", regardless of whether they should actually qualify or not. Come to think of it, I don't know what the UK evidentiary standards ARE for that designation, and I rather suspect the vagueness is going to cause a lot of spiteful claims of that term to increase punishments, either from vengeful victims or prosecutors trying to look "tough on crime".

So I don't think it's either of those things you mentioned.

The main point is the “crime”. But I would suppose labeling everything “hateful” might have something to do with it.
