Will USA border security let my partner in?

Partner was sentenced to 7 months but only jailed for 2 months and got out and serving the rest 5 months outside

It was a breach of restraining order
No assaults or anything though

We are planning to visit America in a years time with our child

Of course the most important detail is missing - when did this all happen? The United States has a mandatory minimum 5 years reentry ban for deported people (conviction as a foreigner usually also means deportation).

Ultimately, only a visit at the responsible U. S. consulate/embassy can give him a definitive answer.

That's good, because Australia is one of the countries that don't need a VISA to come to America. You will need to go through the ESTA system. It's an automated system that makes sure you're eligible to come to America. That's good, because it's better to find out before you leave home if there's going to be any problems for you.

I think you'll be fine. Canada used to not let Americans in if they had a DWI. They were considered "undesirable." But if you greased the Canadian's palms, you suddenly became desirable.
