Anonymous(36-45)+1 yTechnically yes, it falls upon the agencies following the criminal orders, not so much the president who gives them as the president is accountable only to congress. This is true for the practical reason that a president would not arrest himself regardless.
The real problem is when they do abuse such power go after opposition, or worse people who had voluntarily stepped down from power. In the first case your breaking democracy, in the 2nd case your giving all future leaders a sold reason to break democracy.
You cannot do that while congress is mantaining the largest and most powerful standing army in the world under their direct command. That is asking for a dictatorship.10 Reply

Trump was able to take records with him before he left office. Trump said that after he left office the FBI came to examine what he had and told him to put a better lock in the door which he complied with.

If the law does not apply to the president then he can "break" the law whenever he wants such as killing people and refusing to follow the law (stepping down after his term).

Their being a "civilian" is entirely non-relevant. Legals speaking however such agents could still be arrested by any other criminal by the States following such order.
The States however would be unable to practically popes a large federal army and stop such abuse. This is why maintain such a large Standing Federal army, be it U. S. military, FBI, ATF, EPA, etc.. rather than keeping it distributed in the National guard among the State is soo dangerous..
That means at this point after Mara Largo raids demonstrating such abuse, we are as likely to see a dictatorship as congress is unlikely to disband such armies who will eventually be used by a president who refuses to give up power out of the very real fear of what would happen to him if he did.

Anyone guilty of violating federal law can be pardoned by the one president, but nobody guilty of violating State law can be pardoned by anyone but the State Governor where the crime was committed If the State's constitution allows said Governor to do that.
So the President would have to be in cahoots with the governor and even then it would be easy to avoid and hard to hide.
If the President orders someone (probably FBI) to commit such a crime. The State can arrest them for such an act, only the State's Governor could pardon them. - +1 y

Said state's already weaponized injustice system doesn't need the cooperation of the president to persecute them, nor given how slowly their 'justice' system works in the time frame of an election does it really matter if they are eventually vindicated. The broader problem for everyone not just politicians being a the lack of a right to a speedy trial.
That said a State which is soo entirely one sided is also not a state said Republican can win in a general election and as such there is no point in going there.

Trump engaged in insurrection against the United States. The law says the office of the presidency peacefully goes to the winner of the electoral college vote. He tried many ways to stop that happening, up to and including violence.
There's recording of Trump admitting he hadn't declassified the documents he was showing to people with no security clearance back when he was still president. If he had a winnable case, he wouldn't have spent the last year or more playing courts against each other to avoid a trial. I use to think that would be for freedom, but now after the Raids on Mara Largo it seem quite likely it will be to simply take/ retain power in avoiding the now dire consequences of losing it.
Both Conflicts are feared, not in any way desirable. This is why I keep mentioning how many people died in the war between the states and the likely economic and political consequences of a real Civil war. A war that today is unlikely to end given the modern lack of honor.

Instead they just issues a very General warrant in violation of the 4th amendment to raid his house and look thou everything there. We have no idea what the democrats running the FBI were really looking for with such a general warrant at the head of the Republican parties house.

+1 yDoesn't matter anymore supreme court just shut down removing him from the ballot for 2024. So presidency will be between biden and trump. That being said for the most part the president is actually immune to most legal offenses while they are in office. However once they leave office they can be charged for those crimes. In addition certain crimes can lead to impeachment which still has yet to result in a president being remove from office.

You love quoting the constitution, does it say a president can be held responsible for crimes committed in office or not? Does it say an impeachment conviction is necessary for that, or simply that an impeachment conviction doesn't exclude it?

This also means that Biden can just say "No" once his term is over and remain the president indefinitely. The only thing that could theoretically remove him would be congress but considering Biden could just assassinate anyone who would start a vote against him then he would just be president for life without breaking any laws. The two events are not equivalent. Trump took classified documents and that alone probably would not have gotten him in trouble. What actually got him in trouble was his refusal to return the documents when asked to do so to the point that the FBI simply raided his place in Florida and retrieved the documents themselves. Biden, on the other hand took some documents but when asked to return them properly did so. That is the difference and that is why the justice department declined to prosecute Biden and why the justice department is prosecuting Trump. Anyone who can't figure out the difference between the acts of these two people is not thinking clearly.
