It should be a federal crime for ANYONE to sell or give a gun to someone who cannot pass a background check, and ignorance of the person's legal ability to buy a gun would be no excuse.

So if a private seller wants to sell a gun to some rando he meets on Craig's List or a neighbor, and that person would not have been able to pass a background check, the seller goes to jail if the sale is traced back to him.
