Trespass order leads to arrest? Wha?

I’m all for trespassing crackheads. But arrest if you don’t give ID from nothing but business asks cops? Fck no.

This is ridiculous. As far as I can tell the woman didn't do anything wrong other than not wanting to listen to the cop. So the cop decided to charge her with obstructing whatever that means in this context and arrest her to get her to listen to him. I think when this gets to court the court is going to be very Disturbed about the officer's behavior. An important part of constitutional rights is the implicit right to be left alone, which means walking away from a cop and refusing to listen to the cop if you feel like doing that.

Need a bit more info. What was the business that accused her of criminal trespass and what did they mean? Was she banned from there? Was she asked to leave and stayed too long?

Also, the cop seemed to say that since the business said they wanted to file a criminal trespass charge, he had to arrest her. I find that hard to believe. He should have at least gotten her side of the story.

She was rude and kept interrupting him, and I could see him getting very frustrated with that.

Yes, I pared the full video down because she turns into a “Karen” resisting arrest.

But basically, the business JUST trespassed her. That I don’t mind. I wouldn’t want her smelly ass around either. But the cop asks for her ID to validly “trespass” her and of course she says no and tries walking away.

Thus leading to “you’re under arrest” simply for not showing ID as you’re walking on the street. This is a legal issue that needs plugging away by ACLU.

Of course being her crack head ass, she resists, blowing any chance of a black and white (pun intended) argument of the case.

If you have been trespassed or 86'd then entering the premises of that business is a criminal offense making an ID check legal in addition trespassing someone means criminal act has been achieved but you as the owner do not wish to press charges. This also makes an ID check legal as the officer will have to fill out a form with your name gender blah blah blah.

If she trespassing an̈d can't produce I'd or refuses to identify herself it's an arrest.

Truth is in most cases with police a bit of respect and polititeness goes a long way.

The basic problem is the business JUST proclaimed her trespassed. And the cop needs her id to validly “trespass” her. And she won’t provide. So basically she’s being arrested for not IDing to a cop while on the street.

Now she goes on to resist arrest like an idiot. But I’m questioning the legal issues here…

She doesn’t refuse to leave. She refuses to hand over ID. Probably cuz she got warrants. But that’s not a reason to be arrested.

Driving? You hand over license. Walking on street not trespassing previous places you got trespassed…illegal to ID, shouldn’t be arrestable..

if you feel the police are infringing on your rights then take them down. before they take you down
