A business can go years without filing if they're willing to pay filing penalties, especially if they don't actually owe money to the government. Then, you can get an order for an audit, and that can take between a 12 and 26 months, and in some cases, 36 months. As you know, your boy's favorite tactic is delay, delay, delay.
