An upside-down U. S. flag has long been a sign of dire distress and versatile symbol of protest.
Kapernick wasn't cancelled. In fact he made a shit ton of money after his career was in the toilet. Like a lot of "activists" for the BLM movement he made a shit ton of money but he just wasn't producing on the field. A lot of us in the black community are disgusted with the blm and the likes of Kapernick who used black men who are the victims of police brutality as a means to enrich themselves and to dance as performing monkeys for white Liberals. I'm glad I never supported the BLM or gave them money. The BLM was a con, nothing but fake ass college kids of of upper middle class African American families born into Privilege that used it to committed massive fraud.

Patrisse Marie Khan-Cullors Brignac is an American activist, co-founder of the Black Lives Matter movement, artist and writer. Cullors created the #BlackLivesMatter hashtag in 2013 and has written and spoken widely about the movement. Other topics on which Cullors advocates include prison abolition in Los Angeles and LGBTQ rights. Cullors integrates ideas from critical theory, as well as from social movements around the world, in her activism. Cullors has had two books published.
In 2021, a controversy arose in some media outlets, following reports that Cullors (or entities associated with her) had purchased several homes during a five-year period. Critics accused her of using the Black Lives Matter movement to enrich herself and accused her of being hypocritical for purchasing the houses as someone who identifies as a "Marxist". Cullors denied any wrongdoing and defended her actions as an effort to take care of her family and described the criticism as an "effort to discredit and harass me and my family" by the political right. On April 13, the Black Lives Matter Global Network Foundation denied that it had paid for her purchases of real estate and said they had not paid her since 2019, adding that she had only received $120,000 since 2013 for carrying out her work related to the organization.
Her other brother Paul, a graffiti artist and founder of Cullors Protection LLC, received $840,000 from BLMGNF for security and consulting. Cullors defended hiring her brother, saying registered security firms which hired former police officers could not be trusted.
Some BLM activists accused her of "monopolizing and capitalizing our fight." Ten local chapters of the Foundation claimed that Cullors became its executive director “against the will of most chapters and without their knowledge,” that chapter organizers were prevented from influencing the group's direction, and that the national organization provided little to no financial support for local chapters since its inception in 2013. Cullors resigned from leadership of the Foundation in May 2021, and later revealed psychological exhaustion from the controversy, stating that she was receiving treatment for post-traumatic stress disorder.
In 2022, she denied allegations of misusing donations given to the Black Lives Matter Global Network Foundation, but admitted to hosting two parties at a mansion the BLM Foundation purchased for $6 million.

Many right-wing conservatives do not view civil disobedience as patriotism. That's the crux of it right there. They will however support forced doctrination in schools to make impressionable kids pledge allegiance when they don't know what the fuck they're saying and this little ritual was adopted from fascist regimes. They have a very simple view of patriotism stand for the flag is their primary concern. I say burn the flag, it's protected political speech and PATRIOTIC! It always blows my mind when right wing conservatives denigrate and assail the ACLU "who's only client is the Constitution". Make it make sense!

You could argue that the venue the speech was done in makes a pretty big difference. And the capacity in which each statement was made was pretty different.

And a SCOTUS judge has higher standards when speaking in the course of his/her duties as a judge. A Judge hanging a flag upside down on his personal property isn't the same as a judge insisting that the flag over the courthouse be flown upside down. Kaep did his speech in the course of his employment as a publicity stunt. Justice Alito didn't
There will always be someone to think everything and anything. For my part, whatever a justice wants to say as a private citizen in up to their discretion. If a Justice wants to support ANTIFA from the privacy of his or her home, that's up to them.
