A felony is applied when arrested or indicted. As it said in Hur’s report, Biden’s documents were mostly from cleaning out his VP desk. Though bad- Hur didn’t warrant any “felonies” because Biden was corroborative and gave everything back. This no crime.

Trump on the other hand kept it, fought the feds from seizing it, showed the documents off to impress people and was an otherwise an asshole. Thus felony.
