I'm not an expert since I don't plan to go to prison, but based on what I have researched it seems like the main factors should be whether or not you've had lower surgery and whether or not you have a history of violence against a particular sex. If either of those are the case, then you need extra supervision/protection—for the safety of all prisoners involved—regardless of which prison you end up in.
For example: the trans woman who was put in women's prison like normal despite having not had lower surgery and having indeed had a very strong history of sexual violence against women specifically: bad move. Obviously she would target the other prisoners. She should have had special oversight because in either prison someone would have been at very unusually high risk of violence (in the women's prison the other prisoners, and in the men's prison the trans prisoner).
So the short answer: the women's prison, but potentially with special precautions—just like any other high-risk prisoner should be handled.
The only scenario where a male should ever be housed with females is if he's been fully penectomized. Arguably even fully physically emasculated, so even the testosterone levels don't create an additional threat to the females. But this is worst case scenario. Best case scenario is segregated housing in male prisons, so they won't have such a high SA risk by the other male inmates. SA is not a punishment for crime, and protecting inmates from it is necessary. Even the shitty inmates.
If I was an inmate, I would be fine being in a male prison but in segregated housing. I would have no freedom either way, but I would not get rape

There is the issue of preventing sexual activity/pregnancy in prison that many are concerned with, which is why I would say a separate block (if she is pre-GRS only).
Putting a trans woman in either prison would be pretty bad, but I feel like it would be a nightmare scenario to put her in a male prison.

@thearchjoker Not at all. I said housed separately if they are still capable of doing so. If incapable of doing so (no longer having the parts to do so), I see no reason why they couldn't be housed together

The issue with this question is, the guards don’t want the men with women & women with men to discourage sexual activities / impregnation (assuming)
Honestly being a Trans Woman might get guys attentions so, they’d probably put you off in your own cell since you have the lower anatomy (assuming no surgery took place in this scenario), that way women can’t get their ‘fix’ and be impregnated.
I don't know if this is doing justice of my thought process. I’m an ally of LGBTQ+ just thinking about how the prisons would be arranged is strange to me since I’m unfamiliar with the system. TRANS RIGHTS ARE PEOPLE’S RIGHTS! 🏳️⚧️🏳️🌈

Female prison. There would be no issues.
1st If she tries to assault in anyway acting on the privilege man body over them I do very much think all the women would turn hostile very quickly towards this trans, to the point they very much regret it.
2nd Just normal sex? Honestly who cares, and if one questions what if pregnancy? There is a thing called abortion. Just make it so by law they have to have one.
You could also, make a choice if they do any penetration with their penis they are thrown out and taken to a Male prison. Simples.

As per section '1.4 An unconvicted prisoner must not in any circumstances be required, against their will, to share a cell with a convicted prisoner - Prison Rule 7(2)(b).'
Not sure how it is in America but over here you have the right to not be sharing a cell with a convict. Which then it's just up to them which solves me needing to worry about that.
Also, in America, there is no such thing as consensual sex while in custody. That's consider rape here, and we have strict enforcement against that. Female inmates aren't in a position to be able to consent to sex with a male, because they are in custody and in a position of vulnerability.
@BetaBucks It's not rape. It's rape according to law but anyone knows it's not rape if two decide to have sex within custody based on their own merit, and no one would actually agree that's the same as rape.
It's only there to discourage it happening.

And of course. It's simple you don't want to have an abortion don't get pregnant in jail.
You make your choice. It's not as if you want find out randomly it would be something you already are aware of and took that decision to do it anyway.

Though if you don't like abortions then how about we just take away the baby put them in orphanage so your tax dollars can go to it. Then they'll be kids who are growing up without their real parents and typically have a worse off life, not to mentions criminals as parents.

I don't like forcing medical procedures on people that aren't consenting. It has nothing to do with liking or not liking abortions.
And even though you disagree that it's rape, it still legally is, and activist groups spent a lot of time and effort to get laws passed to protect our inmates. As a basic human right, because most of us can recognize that this isn't a position of consent. Even if you don't see our perspective.
Taking the baby away, assuming the mom wants the baby to be born, would obviously be the more humane solution, so we can agree there.
As for the conviction status questions I asked before that, I'm still curious what your perspective is.

Two adults consenting to have sex is never rape pretending it is just because they are in prison is funny. Been forced and wanting to having sex are two vastly different things.
Unless you for some reason are under the assumption all women in prisons don't want sex which is even more absurd, plenty of times like with guards for example they actually came onto them which is for sure not how rape works.
More human but more illogical and hurts more in the process. The child is likely to not be happy, the child is likely to follow their parents footsteps been in cells themselves, wastes money, and the real parents aren't happy as they don't get to see their own children.

Medical procedures it would be consented the very fact you got pregnant would be the consent, it would be like saying well we can't lock up someone without their consent... well you can and have to if they do something that makes it so.
Of course in my world prisoners would be offered protection as I don't see sex in prison as a bad thing. The thing with that is, prisoners are always going to have sex it's normal urge we have it don't stop in prison many will have relationships in there and I don't see any point stopping that and the fact is you actually can't unless you solitary them.
We've had prison reform activists fighting for inmate rights for decades. Just because you don't like it, doesn't make it true. And the point is that there are times when adults can't consent, and one of those is while in custody. That's why we protect our inmates. It has zero to do with them being horny. But I understand you don't see it that way, and that's fine. But this is the way we see it here and it's the way we made our laws.
Getting pregnant isn't consent to be forced into a medical procedure. That's psychotic. Legitimately a heartless way of looking at human life.

In fact something I despise within in the law is not taking what actually happened but just going by what the book says.
This leads to many wrongful and unfair, unjust convictions and more dictatorship rules that don't take consideration of the case.
Even in crimes there should be considerations to how and why it happened, not just oh it happened so book them for max years because that's what the law says let's not think about what or why.
Law is not absolute and there is laws that generally don't help when they should only be applied when they actually do.
Tell me, who does it help if a woman comes onto a guard they have sex both adults, both finding it good to then stop that? And call it rape? Did it help her? No it did not. Obviously if one was convicted for robbery and your in a room with a convicted rapist that has the want to do that to you this would be a very dumb idea. But if both were just robberies yeah why not, they probably get along tbh.

What is heartless is forcing a medical procedure on anyone. Just because they are in custody, doesn't mean they aren't human and don't have basic human rights. And it's not like prison is forever. There have already been multiple cases where trans women have impregnated woman in female jails. thus sending them there is not a option they must be sent to male jails to protect the female inmates.

It's impossible to transition race, and there's plenty of stories about trans men getting treated like shit after transitioning. One even killed him/herself over it. So I don't think this is reality. Studies show women have an in-group bias towards women, and men have an out-group bias towards women, in general.

It's both. All women, in general, and trans women, even more. And trans women are prioritized over cis women, in many different contexts. Like the one we are discussing here. In which you likely prioritize trans women over cis women.
It's not a disadvantage to not be able to be housed with the opposite sex just because you wanted to live along the current gender norms/stereotypes of the opposite sex.

The fact that this is even a discussion is the disadvantage trans women face: they can't just get sent to prison and serve their time like everyone else. It has to be a debate, they have to prove themselves, and no matter where they end up they're still at higher risk of being targeted than cis prisoners are.
Prisons are segregated by sex, not gender identity. That's not a disadvantage, that's reality. I don't get housed with females either, even though I would like to. Of course it would be safer and more fun for me. But more dangerous for them. That's not a disadvantage for me, it's reality of being placed with my biological sex.
Your opinion isn't visible on this post, but if you believe that putting males in prison with females is ever right, then you're prioritizing your trans preferences over female safety. Proving my point about males taking the top of the social hierarchy if they say they are trans.

Yes, because she's a biological female. Unlike a trans woman. And that's why we segregate based on sex. Gender identity is irrelevant. Not to mention a trans woman can stop pretending to be a female at literally any point in time. Especially if it is a threat to her life. But also, my answer was to put trans women into segregated housing with other trans women. Regardless of whether it's in a larger complex built for males or one built for females. Although it makes the most sense to pick the ones built for males.
