In Edmond Oklahoma a student was told to remove the American Flags he put on his pickup truck. The Superintendent had to issue a rule that will allow students to display the American Flag. Is this completely backwards of what should be? Should this be a federal law? Do you think it could be a law if Harris is elected? Do you think it would be a law if Trump was elected?

As I’m not American I had to Google this, it appears that the school ruling around flags has been in place since 2017. It was brought into place in part for safety in the parking lot as large flags are not idea for parking and safety, but also due to fights and hate against American flags where the flag was being grossly disrespected.

The ruling came in to being in 2017 and is now being used politically. It appears the school has flags in the grounds and all classrooms and does the pledge every morning.

The kid in question appears to be a bit of a knob and had been stopped with a knife on display in his vehicle, this and the flag were mentioned and he came back with the not letting me cry story that has went all political.

The other bit is the state Education guy has a bunch of cases against him (potentially).

No there should NOT be a federal law, because the US Constitution IS ALREADY the “supreme law of the land”, and it states that you have free speech, and has already ruled that what you wear, or displaying the US Flag is absolutely speech. So the mere fact that they made him take it off his truck, violated his civil rights! The fact that the superintendent later remedied it, doesn't change the fact that the school violated his civil rights! Also NO it couldn't be a friggin law if Harris is elected, because as previously stated, the Supreme Court has already ruled on this very issue, as it relates to kids in schools, in Tinker v. Des Moines Independent Community School District (1969). In this landmark decision, the Court ruled that students "do not shed their constitutional rights to freedom of speech or expression at the schoolhouse gate.”

@CrazyGirl2 there was a high school student near where I live that came to school with a t-shirt that sad "There are only Two genders.

He brought this to court and the Federal Court ruled against him. They said it targets a "protected class". He lost on appeal as well.

Then I guess, we will see have to wait to see how the Supreme Court rules on this. There’s not really much point discussing an unresolved case, that’s still making its way through the courts.

While I absolutely agree that transgender people are and SHOULD BE a protected class, I do believe that SCOTUS has already ruled that “the truth is an affirmative defense” to defamation. However, in this case, I can see a way he MIGHT loose, because sex (where there ARE only two), and gender are VERY different things. Even my best friend, Maddie (who is a trans-woman agrees that she is STILL male, and that no amount of surgery will ever make her female), but she is definitely NOT a fckn’ man! However, if THAT is HIS opinion, and given that the shirt does NOT in any way call for the discrimination of, nor for harm to come to transgender individuals, if THAT really is his opinion, then he is ENTIRELY within his right to express that opinion freely, as is guaranteed by his First Amendment rights!

It will be an interesting case, when it reaches SCOTUS. I hope they grant it certiorari, and do hear it! Other than that sweetie, until the case has been decided, there's not much more to really say about it.

The problem with protected classes is that it is people with political agendas who decide who is a protected class. The proliferation of protected classes especially during the last 12 years has done more to divide America and turn the clock back 50 years on civil rights.

I’m not going to go from a constitutional/legal discussion to a political one. But I will say trans people need “protected class” status to prevent housing, employment, and other discrimination! My friend Maddie was planning to living in an apartment quite a ways from campus to save money! The issue here is once you are outside the city of Gainesville it is a VERY rural area. She applied to rent a duplex in a town called Archer. She said the landlord, who was asked, “Are you going to be starting at UF or Santa Fe?" (another college in G'ville). She said “UF”. He then said, “Just as long as you don’t cut that pretty hair and become one of them trannies, you’ll be more than welcome here”! What was she supposed to do? Housing's at a premium before the fall semester! She could have just said “Oh no I’ll never do THAT!”, and just kept quiet. But she stood up for herself, and said “Oh I already did that, when I transitioned TO being a woman”. Long story short, he denied her a home! That lawsuit is still going on! But she got emergency housing on campus. Transgender people 100% need the federal protection of “protected class” I’m not aware of any massive new group of people who suddenly received official federal “protected status”, (other than transgender). Private companies may institute policies, States may add groups, but I’m referring to the federal law, and I am unaware of any “proliferation of protected classes” under federal law. My friend needed that protection. If other groups need it too, how does that affect you or your life? Someday you may be in an accident, and need the protection of the ADA. Of if someone tells you “we don’t hire people in wheelchairs b/c you people get enough benefits already, with all those special parking spaces”! Will you just think “Okay, fair enough I suppose”, and just try the next business on your list of places to apply for a job, or would you realize that this was illegal hiring discrimination? They need that protection hun!

You are absolutely correct via tinker as well as constitutional law. However (I forget the case) in the 80s ruled that things "disruptive of the educational process" have less protection and the school can be judge jury and executioner. Almost all schools now have board pass policies where EVERYTHING is "disruptive of the educational process". It's bullshit and the kids always lose now.

@DrPepper12 Well obviously, we need to protect the 28 students who want to learn from the two assholes who are ruining it for everyone! But even students can sue (through their parents) a school which infringes on their constitutional rights. I remember the case of a girl who sued her school because they said her skirt was too short, but allowed boys to wear shorts that were shorter! So OBVIOUSLY kids don’t get the same rights-protections as adults, but they do still get constitutional protection of their rights. That’s what I’m referring to above.

Something very strange is happening… I don’t know why this is happening.

we started a new curriculum this past school year. It has 12 units.
we taught 9 because we started late.
In June, the district told us to skip unit 6.
unit 6 is all about America 🇺🇸 and we all loved teaching that unit.
why is the district eliminating a unit about our country? I am very upset about this. And you know I am an easy going person. I just hope we can continue to do our Pledge of Allegiance in the morning.

why are there so much self hate in this country.

we fly our American flag in our garden all year round. And we see a lot around our neighborhood. And summer time we have our town center decorated with lots of flags from Memorial Day throughout till prob later 4th July. It’s so lovely.

I do not know where you live but I would be very surprised if the state government had a Republican majority. Where I live it is a one party rule they they are democrats. My state rep is one of only 6 Republican state reps currently in office. As a result, the schools and everything else in this state is a mess and thousands of citizens flee for more citizen friendly places every year.

My new principal signs off with stupid pronoun nonsense! I just hope she is not buying into turning our school into all other schools.
We try our best to protect our young students from social media influences.
Our school has very strong families with good traditions and values.

The new program most NYC primary schools adopted is HMH into reading. It has 12 or 14 units. However, our district decided to take out unit 6 which is about America.

There are already many laws on the books dealing with freedom of speech, that allow displaying American (and other) flags.

The only things that could legally prevent flags from being displayed on a motor vehicle would be if they are not properly secured, a potential hazard to other traffic, or if the flag restricted the view of the driver. A flag on the back of a pickup truck, like in the picture, would be just fine.

I don't know when it became forbidden to honor the American flag in schools. It seems to be an indication of what schools are teaching children.

Asswipe who was promoted to his current level of incompetence I would presume. Most administrators only spend 3 to 4 years in the classroom and they were horrible. Even worse 70% of administrators nationwide come from phys ed or coaching positions. They have presumed leadership authority which I've never seen any evidence of.
