      Where do you imagine such a requirement is written in to the Constitution?

      The idea of Birth place Citizenship kind of misses the whole propose of Citizenship which is the establishment of your loyalty.

      Birthright by contrast is something you get from your parents not the entirely random place you happen to come out of your mother.

      That is why few if any countries on earth are insane enough to recognize birth place citizenship rather than birthright citizenship. its also why the 14th amendment adds the Subject to the jurisdiction thereof clause.

      Either way Trump simply has to stop issuing the citizenship papers to anyone who can't prove their parents were Americans.

      If the court disagrees he can tell them to the same thing James Madison the Constitution's author told the court in 1803.
      In a constitutional republic 1 branch of 1 goverment doesn't get to command the others to do anything, only refuse to cooperate.

    Hopefully the court will recognize your birthright is your inheritance from your parents as it is in the context of every other use of the phrase and we won't have to overthrow the court.

    Either way this should be enforced as is, and we should deny people without American parents the presumption of citizenship.

    In a constitutional republic 1 branch of 1 goverment does not get to tell the others what they MUST do only veto what they actually do. That means illegal aliens are no more entitled to the documents of citizenship than Marbury was to his writ to be a judge in Marbury v. Madison (1803).

    As such it is by no means required that the court agree.

    That's one I don't agree with, I think it means some babies will have to have legal rights and lawers asigned to figure out what country the belong in?

    It will "alter" the illegals game to come to america. Maybe niterview some mexican gangs as they are more devious.

      Citizenship is in concept related to the idea of loyalty or allegiance, not land. Land changes hands all the time and it is the loyalty of the people who live on and control that land that really defines who controls it.

      That is why there is a difference between an invader and a citizen as related to control of the land being a direct consequence of the allegiance of the inhabitants either inline or opposition to what you regard as your countries sovereignty. This is the point of "subject to the jurisdiction thereof" in the 14th amendment.

      Clearly it is extremely important practically, because if people settle a particular land, if they are not loyal to you then it might as well be their people who control the land, and thus practically the land is part of their country not yours.

      This is why almost nobody on earth is insane enough to recognize birth place citizenship. This progressive idea is largely made up, and introduced like a lot of other bad ideas using the irresponsibly poorly written 14th amendment.

      It is at odds with the very propose of citizenship.

    He hasn't banned anything yet. Something like that has to go through Congress. But surely it would prevent pregnant women from coming into the country even legally. I know that some countries have actually passed laws that if you're too pregnant, they won't even let you board a plane to go there, because they had too many issues with women flying there just to give birth

      Your correct, who ever got that idea wasn't the smartest apple in the barrel. It misses the whole point of Citizenship. Don't get me wrong they read it out of the 14th amendment choosing to iqnore the subject to the jurisdiction there of qualification.

      The people who wrote the 14th amendment were fairly shortsighted and dimwitted but not that dimwitted.

      Originally it was to encourage for migrants to come America and be citizens for themselves and their children and fill it because the country is huge but it should have long been changed.

      That is the concept of naturalization, the idea of citizenship is much older than that and is inherited from you parents as a birthright just like other birthrights like nobility or title in Europe at the time.

      The idea of settling lands is in fact a critical example of why the idea of birth place citizenship is insane and never recognized particularly in frontier countries like America. As control of the same lands very much depends upon the loyalty of the people who live there.

      The idea that the people who wrote the 14th amendment then recently in dispute did not mean to exclude forign nationals with the subject of the jurisdiction thereof qualification is kind of nuts.

      They were foolish and illresponsable with how they hastily wrote the amendment but not that foolish.
