I haven't read the story, but police procedure is to ask for an ID from EVERYONE. Not just someone who might be illegal. If he were arrested and didn't have ID, then he could have made a phone call. ICE always checks for documentation. If this person has a Social Security card and a Birth Certificate (which he would have, if he had been born in the US), then ICE would not deport him.

Of course I am OK with a right to a speedy trial. I don't want to be left to rot in some dungeon as it use to happen in England. Either charge and give me a fair trial in public with qualified legal defense before a jury of my peers or me or let me free. In that guy's case it seems that he was picked up at a traffic stop and his form of identification was under question for whatever reason. Maybe he had a fake ID on him in addition to his real ID for buying beer or getting into nightclubs with an alias name. A lot of young people do. Maybe he had no drivers licence and refused to identify himself. I don't know. It seems his identity had to be confirmed by a judge, and once it was he was released within that 72 hour window. I don't know all the details of why he was kept in custody, but clearly an investigation took place and they got to the bottom of his identity and he was release as he should be. That is the just thing to do, release an American citizen if they are wrongly suspected of being an illegal alien.
