Who is guilty here?

If someone buys a fake gun that shoots paintballs but it turns out to be a real gun and it kills his friend, who is guilty? The shooter or the seller?

There is a big difference between loading a gun with paint balls and loading it with live ammunition.


So let’s assume the shooter didn’t load the weapon and put the ammo point aside


When you point a loaded gun at someone and fire it you do so knowingly, not knowing what projectile will come out of it is still your fault , and isn’t much of a defence and difficult to prove , at the very least your just additionally guilty of being stupid , negligent , ignorant or complacent , by not taking reasonable precaution to find out before hand


So the difference legally would be quite small and likely surrounding ‘intent’


So the shooter is still guilty , it’s just what exactly they are guilty of that changes.

I count 2 idiots in this picture. But this is a bad analogy. Both people would have to be morons to mistake a real weapon for a CO2 powered paintball gun. Just trying to load the paintball gun you'd have to realize there's a magazine with something that does not look like paintballs inside.

Who loaded it? Real guns aren't loaded when they are sold.

You would have to be at least negligent if you cannot tell a paintball gun from a real gun.
