What difference does it make if the government is violating any parts of the law, including the Posse Comitatus Act? The government now breaks the law on an almost daily basis and does not even attempt to hide this, and yet there are scores of lawyers and Courts quoting the law and yelling that the government is breaking it. They might as well be waving a law book at Jesse James and telling him to stop robbing banks for all the good it will do them.

There is literally no way now to enforce Federal laws, including the Constitution, as the Courts have no police, or those they do have are under the control of the Executive - in other words, the lawbreakers control the police, or in some cases they ARE the police.

Laws are enforced through the courts. Every time one of President Trump's policies gets stopped by a Democrat judge, the appellate court usually can overtrmurn it.

I have no idea why that occurred, but it began in the early days, and I suspect that Trump was testing the water to see what he could get away with (there was a long delay in returning Garcia), and before he was returned, the government said they intended to bring him back, charge him and try him (or maybe not) and deport him to Uganda. It took a lot of court interventions to keep the government from doing all or most of this. As of now:

Kilmar was released from a Tennessee jail in August 2025 and allowed to rejoin his family in Maryland while awaiting trial on human smuggling charges. He is under home detention with electronic monitoring; his brother serves as his custodian.

A federal court has temporarily blocked efforts by ICE to deport him again, extending his temporary protection. A critical evidentiary hearing is scheduled for October 6, 2025, where former Trump administration officials are expected to testify.

Kilmar has formally requested asylum, aiming to secure protection and prevent deportation, particularly to Uganda—a country he has no ties to. His application could pave the way toward legal residency and possibly citizenship.

While released from jail, Kilmar still faces uncertainty. His legal team objected to the charges, viewing them as potentially retaliatory and politically motivated, filed only after his wrongful deportation.
