I have no WSJ subscription, so I can't read the article. But here's my take on the 50/50 custody. In general, it's a good idea.

It's a bad idea if the father has been abusive to the mother, children or both and continued contact with the mother could be a threat to her. Or, if the father won't hold up his 50 percent of the time.

It's a great idea when the father's responsible and wants to stay involved in his children's lives. It gives both parents breaks from the children to lead adult lives when the kids are with the other custodial parent. So, in a way, it mimics how a family works with two parents present in the lives of their children all the time.

It also shows the children the two styles of discipline and living with each parent. It teaches flexibility to them. It also requires the parents to co-parent. They will have to talk to each other about their children and how they're behaving at one household or the other. There will have to be co-parenting compromise.

Now, if there is a contentious divorce, a lot of anger between the parents, then, again, there are risks that this will not work if the parents can't come to a denouement with each other. It's more complicated, but could work out better for all concerned.

Neither. Kentucky is one of many states that has dad by default laws, as well as laws against men testing a child’s paternity without the mother’s knowledge and consent. So a 50/50 custody standard really just demands that men keep providing for women and other men’s children.
Until every jurisdiction in the US requires DNA testing before paternity is established, every other law concerning parental rights and responsibilities is a travesty of justice.

Kentucky did something right doing away with voluntary servitude. Hopefully the other 49 states follow suit
