If they are so strong in their belief of becoming a US resident or citizen, wouldn't they be waving the US flag instead? This isn't Mexico, and while the US is seen as a melting pot, we are our own sovereign nation.

I'd say if you are flying a common flag during a criminal event, it shows coordination and cooperation with a group, not independent action. Thus, you could hit the criminals with an additional conspiracy charge on top of a terrorism charge, given that there was forethought to cooperate in a violent political criminal action under the same banner.

Federal Conspiracy is 18 U. S. Code 371, which carries a possible penalty of up to 5 years in prison for conspiring to commit any federal crime. So tack on an additional 5 years in federal prison.

That said, if they were legal immigrants, their visa could be revoked and they could be deported for committing criminal actions. If they are citizens that immigrated here legally, then you could still prosecute them under anti-communist laws which are still on the books and strip their citizenship for lying about association with communist/socialist groups. Then there's always terrorism and treason charges which you can strip citizenship for as well and deal out the death penalty if appropriate by hanging, firing squad, or electrocution.

The thing is, the people waving the Mexican flag are not uniformed Mexican soldiers. So you can't just treat it as an invasion by the Mexican government. The country of Mexico has not officially declared war on the United States. However you can still treat the group as a belligerent. For example

So being that ANTIFA and it's affiliate groups are a non-State party to the conflict and they have occupied particular cities, they can be held accountable for obligations to maintain public order and safety. If they attack civilians (i. e. riots), they could be tried for war crimes and be put to death.

Of course free speech is fundamental to American values, and I support that. Waging an invasion on American soil, however, is an act of war and even treason in many circumstances. The expression of itself is not a problem. It is the intent along with engaging in illegal activities that IS the problem. Obstructing ICE operations is a crime.

It is a cloth representing another nation. It is fine to admire a flag from a nation one is from, but when it is used during a riot situation and especially during an operation to apprehend illegal aliens, then it is a show of defiance to this nation from those who are not from here.
