Apparently there is another video angle when he was shot. When he was fighting on the ground he reached back for his gun and fortunately the gun wasn't there and he grabbed one of his spare clips instead.

He seems like a unhinged person that his first interaction with ICE he got a broken rib so decided to bring a gun and several extra clips of ammo. Looks like he had a plan that didn't go his way.
