Every assertion that AI can replace educated, trained, skilled and diligent workers is essentially an assertion that AI is superior in every way, or outright infallible. However, we’re already seeing prominent cases of AI messing up so terribly that if a human made the same “mistake”, they would be fired. They might even be charged with one or more crimes. Instead, the people and organizations relying on AI are just saying “Oopsie!”, and going back to their business like lives aren’t being destroyed. So what are you going to do when you end up in prison for a crime you didn’t commit and NOBODY is fighting for you because AI is never wrong?
The AI system is irrelevant because it can't be used to prosecute you in court. Disregarding the fact that they are fallible and anything they say is, at best, hearsay, constitutionally, you have the right to face your accuser. Since an AI cannot testify in court, they cannot be cross-examined and thus any testimony of theirs is unconstitutional as a violation of the 6th Amendment. The specific clause is called "The Confrontation Clause".
Amendment VI In all criminal prosecutions, the accused shall enjoy the right to a speedy and public trial, by an impartial jury of the state and district wherein the crime shall have been committed, which district shall have been previously ascertained by law, and to be informed of the nature and cause of the accusation; to be confronted with the witnesses against him; to have compulsory process for obtaining witnesses in his favor, and to have the assistance of counsel for his defense.
However, I think late, great actor Elijah Cook as attorney Samuel Cogsley can do a better job illustrating the injustice from machines making criminal accusations.
Background: In the Star Trek episode "Court Martial", Captain Kirk is the defendant in a court martial trial as the USS Enterprise computer log shows that Captain Kirk took action (jettisoned the ion pod during an ion storm) during a yellow alert that led to crewman Ben Finney's death. Such an action should only be taken while under a red alert.
In the end, Kirk was exhonorated because Finney did not die but, in an act of revenge against Kirk, deliberatly corrupted the computer's memory to show Kirk committing the crime that he didn't actually commit (Kirk DID jettison the pod during red alert and after Finney left the pod).
The AI is absolutely not irrelevant. It is being used as “evidence” to charge people with crimes. Some of which the accused have not done. Watch the videos. It’s not science fiction. It’s happening now.
I understand what you are saying. AI can be used as a tool - and will be used as a tool to make predictions among other things - but, ultimately, in court, evidence has to be presented by humans who can then capable of being cross-examined. If AI generates something, it will need some form of root source of information to cite. It is then the cited information that becomes the evidence and that is what can be challenged at trial.
Well obviously, one has to hope that will not happen. We can engineer events to certain degrees, but we're also at the mercy of other factors, such as humanity stupidity, social forces, and 'karma'/life lessons.
The main problem is obviously the kind of thing we saw with covid. Most people are unthinking, put their faith in authority, and do not question themselves. They choose convenience and the path of least resistance. But this can be very dangerous.
In the UK, this is a very real threat. Everything is dovetailing for the authoritarian left, whose paradigm is crumbling, so they're trying to cling on to power with whatever means they have. Namely, we have the digital ID scheme. We also know that there is a plan to roll out facial recognition across the UK, and they will use databases of national ID's. This is has very dark implications. We also know there has been another of cases of false positives. And funnily enough, it seems to be far less accurate for ethnic minorities.

I won't much care to be honest. I have options regardless of what it says I did, and what it says I did, won't put me in jail. At absolute worst, just swallow a slug and let someone else clean up that mess.
