It not an American base.
They are jointly operated military bases that are under Spanish Sovereignty. Since they are under Spanish Sovereignty that gives Spain the legal right to refuse the USA to use it.
It doesn’t matter if both countries are NATO countries. The USA is still required legally to have consent if they want to use it.
If they use it without permission from Spain then that is illegal.

The bases in Spain are, by agreement between the two countries, joint-use bases. Other NATO allies are allowing use of bases on their territory.

You'd have to look at the wording in the agreement with Spain, but generally the US has full operational use of the joint-use bases in NATO countries.

They needs to be an agreement from both parties and not just one party. Using Spains military bases without permission would violate the international law.
