Should AI generated nudes be illegal?

As AI has taken off and become more advanced, an emerging trend has been using AI software to convert swimsuit pics (mostly of women) into nude pics. I even tried it out with a free software just to see if the claims that its easy to do are true and they are. I used a thong bikini pic of an Instagram model and after running it through AI, it gave me a generated pic of her bare butt. Taylor Swift has even been a victim of this, there was recently AI generated nudes of her released on Twitter/X and they must have been anatomically correct because she’s getting her legal team involved because of them. That’s why I was wondering if anyone thinks that the distribution of AI generated nudes should be penalized because it seems like they’re becoming anatomically correct as AI advances and obviously you can’t criminalize the creation of the nudes, only the distribution of them and even that is only a maybe because that seems like it could be shaky legal ground since they’re technically fake computer generated images.

Look, no woman is going to be surprised that tech bros are using AI to strip women before their eyes at any given opportunity. It doesn’t really matter if the images are accurate or not, but this falls into that same weird vein of deepfakes and how it’s not “technically” a violation of privacy, just using someone else’s image without their consent which, thanks to copyright laws in the US, doesn’t make it illegal provided they’re not using the image to make money. It’s bullshit, and we have no choice but to be resigned to men who would rather see us naked regardless of our willing consent because that’s the only way they feel powerful.

No. That is an extremely slippery slope. As you point out, generating nudes isn’t illegal. If i have skill and imagination, i can draw a “nude” based off of a photo or portrait. Should that be illegal? Should it be illegal if the artist instead exaggerates certain features so that it’s not presumably anatomically accurate? Will we then outlaw the lookalike fakes that are already out there? If people are titillated at the thought of one person performing sex acts because they look like someone else, is that oppressive to the person the performer looks like?
Taking and/or releasing ACTUAL private images without permission is and should remain illegal. But any and every artistic rendering, no matter how potentially accurate, should remain protected by artistic license and freedom of expression.
