It is criminal “invasion of privacy” in California. Which makes it a misdemeanor and carries a penalty of up to 6 months in county jail and/or $1000 fine.
I know Florida passed a law forbidding it. I don't live there but I recall seeing a story when I was visiting relatives about. woman who chased a man out of a Target for trying to upskirt her. The police caught him.
I think it's an indecent thing to do to someone, but I'm not so sure it should be criminalized to this extent. Maybe a costly ticket would suffice. It just seems odd that women can wear whatever they want, even be completely nude, and if you take a picture of them in public which is perfectly legal it's illegal under certain circumstances. Wouldn't it make more sense to just ask women to wear proper clothing if they prefer men not to take pictures of them in public?
The problem is not what women choose to wear, it's that men believe that clothing determines how much respect a woman deserves. Perverts will always be perverts no matter what women wear.

What's the problem honestly? You're taking photo and video of upskirt for your own use. What business is that of anyone else. I mean you're not actually touching or making a scene about it, but it's illegal because I wanna shot of a woman's crotch? Dumb laws. Who ultimately really has any right to tell anybody what to do?
