I think this is a travesty of justice. One man on that jury stood his ground and refused to allow nine women to bully him into letting a cold blooded mass murderer of children go free just because she’s a woman.

It's sad that the trial ended ins hung jury mistrial, but Massachusetts law makes it very difficult for the prosecution to get a guilty verdict when an insanity defense is used. Due to Massachusetts law, that's the revers if every other state, all the defense has to do is poke doubt in the Prosecution's case, whereas other states require the defense to prove the defendant was mentally incapacitated.

What she did is wrong. Whether she is legally responsible is still up in the air. It will be interesting to see how the retrial goes, reportedly to start later this month.

@Iron_Man I've served injuries, including one capital case. I wouldn't want to serve on this jury, too high profile. If I did serve, though, I would find her not guilty, not criminally responsible, since the Prosecution did not satisfy what Massachusetts Law requires, proving beyond a shadow of doubt that Lindsay Clancy knew what she was doing was wrong at the time she killed her children. The defense provided enough doubt that her post-partum and failure of mental health providers to help her may have caused her to not understand what she was doing.

The prosecution didn’t fail by any stretch of the imagination. Even the defense’s own psychiatric expert said flat out that Clancy could not have been suffering from any form of postpartum stress eight months after giving birth. Clancy checked herself out of treatment facilities. She demanded prescriptions but refused to take them as prescribed. She faked multiple journal entries and her “suicide” attempt. She deliberately gave her husband errands that would keep him out of the house long enough for her to execute those innocent children. Those nine women on the jury made up their minds to let that woman go free just because she’s a woman before hearing any facts and they refused to let any quantity or quality of evidence change their minds.
Lindsay Clancy is a remorseless, cold blooded mass murderer of children.
She’s fighting the charges but claims to be sorry. Those concepts are antithetical to each other. She 100% killed her kids. If she felt bad about it, she would never have gone to trial. She would accept whatever punishment the state suggested and plead guilty on day one. She’s fighting the state because her life is the only one that matters to her.
Furthermore, Massachusetts absolutely has NOT made it difficult to convict defendants who apply affirmative defenses. There are multiple high profile cases in which MEN with well established mental defects were soundly convicted of their crimes and held accountable appropriately under the law. One was literally in an inpatient treatment facility when he assaulted someone. He was still convicted!
They only have a history of letting women off the hook. Any excuse will do for female defendants. No defense is adequate to let men get away with murder. This isn’t a problem with the laws. It’s a societal disease that we refuse to hold women accountable. You should be ashamed of yourself for valuing the life of a cold blooded mass murderer over the lives of three innocent children.

Clearly you don’t understand what “not guilty” means. She 100% planned and executed the assassination of her own children. Multiple experts, including the defense’s own, testified that Lindsay Clancy has never experienced a psychotic break. She’s a liar and a cold blooded killer. Only a Not Guilty verdict would let her go free, and that is not what I would vote for. It is also not what 11 of the 12 jurors agreed on.

Hospitals aren’t prisons. There is no hospital in the country that can keep a person who doesn’t demonstrate a threat to themselves or others. MULTIPLE psychiatric professionals, including the defense’s own, testified that Lindsay Clancy NEVER suffered a psychotic break. Postpartum psychosis is completely out of the question. She had seen multiple psychiatrists before and none of them saw fit to hold her, including an inpatient program in which she was enrolled at her family’s behest. If you get your way, she walks free! She is not now nor has she ever been crazy. It’s all an act and as soon as she gets to be free, she’s miraculously cured, and a new millionaire.

If he doesn't try her again, Plymouth District Attorney Tim Cruz should be disbarred and tried himself for accessory after the fact. If nothing else, the jury should have found her guilty by way of insanity. I might understand an emotional explosion causing an irrational murder or suicide but this was a systematic execution like Jihadists would. Presently, such a verdict can't be done because groups like the American psychological association like the muddy the waters. That being the case, the jury should have invented it.
