Local pub has topless waitresses. I get along really well with one of them and want to date her, but I feel it would be tacky to ask her out while she is working. She is really nice, we get along well amd we usually chat if there is not many other customers she has to serve.

Just keep in mind that they’re working so on one hand they have to be nice to keep their jobs (even tolerating rude and creepy behavior) and work for tips. Second hand they also have to maintain professionalism so being too flirty can also get them in trouble.

Best way to go about this is wait until you get the check… then ask her. If she says no it’s less awkward.

Chatting can be a good sign but it can also just be her passing the time and someone can chat with you and like you as a person without feeling attracted. But if she seems really engaged in the conversation and is leaning in and making eye contact. Those are good signs.

You are at least in your mid thirties to mid forties. The waitress probably in her late teens or early twenties. That makes an age difference of at least 15-25 years.

Do you honestly think that a waitress that is probably also a hoe in her free time is likely going to let herself be fornicated by a person that is 20 years older? I mean, what is the chance of it and how many such "offers" do you think she gets night in and night out?
