The terms and conditions of Instagram, as well as most websites, is that anything posted on the website becomes the property of the website; users agree to that when they first sign up. So long as someone doesn't break the website's written rules, posting pictures for comparisons or other purposes should be legal.

It's legal unless it is blackmail, defaming, or if it was obtained in an illegal manner. Otherwise it is public domain. Just like how a stranger in public is allowed to take your pictures or record you. Think about celebrities etc.

It is technically a violation of copyright law if you do not have permission or own it. Realistically, you won't get sued unless you try to sell them or use them for financial gain.
