Any car insurance agents on here? Weird story I need clarity on. I live with my brother (22), he does not have a license or car insurance. One night he was in a friend’s car (owner of the car was driving) and the driver crashed. I was not present or involved in the crash. My brother lost all his front teeth and part of his jaw. The drivers insurance is covering some of the medical expenses for his teeth, not all of it, so our father (who does not live with us) provided his car insurance to cover the remaining costs. My brother has a lawyer sorting all of this out. The confusing part is, now the lawyer is asking for my car insurance (my brother is not on my policy). He claims if I provide my insurance also, because I live with my brother my underinsured coverage can get my brother additional “pain and suffering” money basically. The lawyer is claiming my brother could get up to $100,000 and it would not effect my rate or coverage at all. This is causing a lot of problems between my family because I think it is fraud and I’m saying no even though they are offering me $10,000 out of the settlement. My reason for saying no is I don’t want to be charged with insurance fraud later. Has anyone heard of this? This is fraud right?

Wait, stop... Cars are insured, not drivers, unless they are a regular driver of the vehicle. Your policy has coverage limits for damage, medical, etc. If the accident wasn't the driver of your cars fault, the other drivers insurance carrier should cover at least some of the expenses. If they don't often your insurance company will sue the other insurance company.
Who was at fault?
Also, I don't think your auto insurance policy would come into play. The attorney should know the law in your state and HE would be liable for guiding you incorrectly. I suggest you reach out to @olderandwiser who is an attorney.
It was not my car and I was not the driver I was not even at the accident it makes no sense

Just out of curiosity why do you think this? I was not at the scene of the accident and my brother is not even on my car insurance. They’re saying because he lives with me and is family they will. Doesn’t make sense to me that my insurance would cough up thousands of dollars for someone who isn’t a customer
