Sue the owner. It depends on if they're uninsured and you have uninsured motorist as well. Regardless you can always sue to garnish wages and what not. I'd get a lawyer at your point if your insurance is failing to make you whole.

Especially if you have a note, generally there are forgiveness clauses in those loans if they're totaled to put the full loan value towards a new car, the bank really wants you to pay that off, and your motivation gets pretty low if you have nothing to show for it.

Call your bank, call the insurance, call a lawyer and ask if they'll take it on if the first two are spinning on their thumbs.

I don't know what country your in but in the UK you either go through an accident management company or your own insurance company they contact the other insurance company and argue it put between them using any evidence like dash cam footage to prove who is at fault.

In the meantime the car goes to the body shop and gets repaired or written off bills get paid and the insurance companies argue over who is going to reimburse the other company

Depends if you had full coverage on your own car or not, if you’re not at fault they go after the other persons insurance unless they had no insurance they have to cover the costs and even the deductible on yours but your insurance will cover it first if you have full coverage but if you only had basic liability you have to go after the other persons insurance and hope they cover most of it

It would be very rare they dispute over a car cause it simply isn't worthwhile too.

Generally they’ll provide legal representation… but consider getting a lawyer yourself. They may even go after your own insurance but for good reason

If you only have liability insurance, nothing. But you can sue the other driver if they don't have insurance; though typically if they don't have insurance they don't have much money.

When you get in An accident your insurance makes you pay a deductible for the first part of the bill. If you have a thousand dollar deductible you pay the first thousand dollars and insurance pays the rest. The lower the deductible the more expensive are the premiums.
