I feel only the person who is in relationship is cheating, the other one is not betraying anyone.

The cheater, because the cheater made the decision to sleep with someone else.
Unless it's an open relationship, then both are to blame.

The person who is in the relationship is blatantly cheating, the person who isn't in a relationship could be innocent or guilty depends if they know about the relationship status of person their sleeping with.
