9th grader sues over Pledge of Allegiance confrontation

The parents of a ninth grade South Carolina student who said she was accosted by a teacher for walking to class instead of stopping and reciting the Pledge of Allegiance are suing the teacher, principal, school district and state education officials.

Marissa Barnwell said she was walking quietly to class and decided not to stop for the pledge or a moment of silence that followed. A teacher yelled at her, confronted her and pushed her against a wall.

Barnwell was then sent to the principal's office, which she said was humiliating because she feared she was in trouble. The principal sent her back to class, but Barnwell said he never let her know that the teacher was wrong and she was right.

“I was completely and utterly disrespected,” Barnwell, 15, said at a news conference Thursday, according to The State newspaper. “No one has apologized, no one has acknowledged my hurt. ... The fact that the school is defending that kind of behavior is unimaginable.”

Barnwell's parents are suing the River Bluff High School teacher, the principal, Lexington School District 1, and the South Carolina Education Department in federal court, saying they violated the girl's civil rights and her First Amendment rights to both free speech or not to speak at all.

A state law passed more than 30 years ago requires public schools to play the Pledge of Allegiance at a specific time every day.

But that law also prohibits punishing anyone who refuses to recite the pledge as long as they are not disruptive or do not infringe on others.

West Virginia State Board of Education v. Barnette, 319 U. S. 624 (1943), is a landmark decision by the United States Supreme Court holding that the Free Speech Clause of the First Amendment protects students from being forced to salute the American flag or say the Pledge of Allegiance in public school.

I (19M) have a kinda hot TA in her mid-40s in one of my community college classes. She has big breasts, and altough she covers well, its still tough to focus on the lesson. This week, she was really acting all annoyed and fussy. All my classmates were saying they don't really understand whats happening with her.

Yesterday, she decided she would not allow us to have our notes during the final exam and she had discussed that with the professor, and when students started arguing, she told everyone to shush. I then told her she would be prettier if she smiled. She told me to come up front and say that again. So I went up and said it again. She told me she will call the college to complain about me if I continued any such behavior. I said it's a joke.

I then asked her if its that time of the month, and the class started laughing. The TA turned and slapped me across the face. I then got angry because she used violence and I decided to go at her, push her and punch her. As I was pushing her, she grabbed me by the groin through my jeans 👖and started squeezing. She squeezed so hard I had to stop pushing her and I was begging for her to stop. She stopped and released me on the floor in front of the blackboard.

I was in so much pain. When I stood back up again, she told me I better never talk to women like that again and try to hurt them. She said I'm lucky she won't report me.

The students were laughing and I stayed on the ground like 10 minutes, during that time she continued her lesson normally, stepping over me to teach. She kept saying how sexual harassment was against the college rules and pig like me deserved this and bla bla bla.

Now I'm thinking I want to sue her, should I? She made fun of me infront of everyone, caused me pain for a few days where it would hurt whenever I touched down there.

Who knows if she caused damage

Esmeralda. Wavy medium-length black hair. Hispanic; light skin. Very short (5'1"). Curvy build with C cups and a bouncy booty. Accounting college student. Calm, optimistic, artsy, and very girly, but also a bit fickle, superficial, and likes to be pampered often (from being girly).

Gloria. Medium light-brown hair. Medium-light skin. Tall (5'11"). Medium build with B cups and toned arms. Sells used cars, but comes from a rich family. Stern, controlling, high maintenance, a feminist, hot headed, and judgmental, but upper middle-class.

Students are expected to be on time to each class.
Students are expected to maintain the same standards of professionalism online that they would need to have in person.
No controversial imagery or behavior will be tolerated in any way and will result in immediate dismissal from the course.
These policies have been instituted to foster a productive learning environment and any violation of these policies is considered grounds for permanent dismissal from class.

This professor will not excuse absences under ANY circumstance, either.
