Summary of the charges against former President Trump in the case regarding illegally retained defense-related documents.

I am writing this MyTake at approximately 00:45 CDT on T 13 JUN 2023.

On Thursday, 08 JUN 2023, former President Donald J. Trump and his assistant Waltine Nauta were indicted by a Federal grand jury on 38 counts of violating Federal law.

The next day, Friday, 09 JUN 2023, the indictment was then unsealed for everyone to read.
I encourage you to read the indictment as it concludes transcribed conversations and numerous photos of where documents were stored within Trump's Mar-a-Lago residence.

Trump will be arraigned in the United States District Court for the Southern District of Florida on Tuesday, 13 JUN 2023.

This indictment is rather large with a total of 38 counts; 37 against Trump and 6 against Nauta. Piecing together all the information regarding the charges takes time. This is especially so if you don't know where to look for a specific law (aka "statute") or even how to identify it. While I am not a lawyer, this MyTake is a summary of the charges against Trump and Nauta.

This summary is in three charts that I built after going over the indictment and consulting with the Legal Information Institute of Cornell University as well as some information from other Federal sources.

The three charts are:

• Chart 1 is a chart showing the specific counts and the crime committed, who the defendant is for that count, and what statutes in the United States Code (USC) were violated.
• A chart with the text of the specific statutes identified in the indictment.
• The first 31 of these charges are all "Willful Retention of National Defense Information" for violating 18 USC §793(e), a section within The Espionage Act, which is currently Title 18 Chapter 37 of the USC. All 31 charges are against Trump only. Each of the 31 charges is for illegally retaining a document that contained "national defense information". This chart identifies those documents and their classification markings.

This indictment is very thin. There have been precedent set on who has the discretion on who has the ability to declare something a personal record (it is the president). Under that ruling this will be dismissed. As usual, the fake news is having their celebration too early. You thing they would have learned by now.

Have you read it - and seen the pictures?
The pictures in the indictment include pictures of boxes of documents IN A BATHROOM.
No one would store documents in a bathroom - and certainly there'd be room in Mar-a-Lago for these boxes... And there was... So why are they in the bathroom? They were deliberately moved there to avoid discovery. They were even hiding stuff from Trump's own lawyer in an effort so that lawyer would not be able to give stuff back to the Federal Government.

This is just not looking good for Trump.

His best bet is that this case rides out past the 2024 election and that a GOP President (not him) is elected who can pardon him. (He won't be able to pardon himself.)

Happy birthday to Trump, by the way; he turns 77 today.

And a President being able to declare classified or unclassified is irrelevant.
The facts are this:
1. Trump had documents that belong to the Federal Government.
2. Once Trump stops being President, he must return these documents under the Presidential Records Act.
3. The National Archives noted that documents were missing and solicited Trump to return them.
4. The request was not immediately fulfilled and 1.5 years of delays ensued.
5. Some of these documents included national defense information (regardless of classification; in fact one of the 31 documents in the indictment is not classified).
6. Regardless of Trump having been President or not, he was in possession of such documents but was unauthorized to have them.
7. This is a violation of 18 USC §793(e).

Whoever having unauthorized possession of, access to, or control over any document, writing, code book, signal book, sketch, photograph, photographic negative, blueprint, plan, map, model, instrument, appliance, or note relating to the national defense, or information relating to the national defense which information the possessor has reason to believe could be used to the injury of the United States or to the advantage of any foreign nation, willfully communicates, delivers, transmits or causes to be communicated, delivered, or transmitted, or attempts to communicate, deliver, transmit or cause to be communicated, delivered, or transmitted the same to any person not entitled to receive it, or willfully retains the same and fails to deliver it to the officer or employee of the United States entitled to receive it...
Shall be fined under this title or imprisoned not more than ten years, or both.

This case is simple and a clear violation of 18 USC §793(e).

It's the other charges that he really needs to be worried about because they carry more time.

What kind of law enforcement agency takes photos to use in an ongoing trial and turn them over to the media? This was done to make Trump look bad. It could easily be argued that since the FBI kicked everybody out and already staged that fake photo of all the top secret documents on the floor and gave this photo to the media as well who can be sure all these other photos were fake as well?

They didn't "turn them over to the media", they were part of the indictment, which is public record. Oh, wait, do you mean the ones just after the search warrant was executed? If they hadn't released them, you would have been one of the loudest shouting that there's no proof that they found the documents they claimed.

Some of the photos in the indictment were taken by Trump staff, like the one of the documents on the floor when a box fell over.

The photos were not fake. In fact, the photos in the indictment were not previously released.

The photo below wasn't taken by the FBI. It was taken by defendant Waltine Nauta when he was complaining to another Trump employee that boxes had fallen over.

This is discussed in Item 31 of the indictment.

On December 7, 2021, NAUTA found several of TRUMP's boxes fallen and their contents spilled onto the floor of the Storage Room, including a document marked SECRET REL TO USA, FVEY, which denoted that the information in the document was releasable only to the Five Eyes intelligence alliance consisting of Australia, Canada, New Zealand, the United Kingdom, and the United States. NAUTA texted Trump Employee 2, “I opened the door and found this..." NAUTA also attached two photographs he took of the spill. Trump Employee 2 replied, "Oh no oh no," and "I'm sorry potus had my phone." One of the photographs NAUTA texted to Trump Employee 2 is depicted below with the visible classified information redacted.
TRUMP's unlawful retention of this document is charged in Count 8 of this Indictment.

@abc3643 As far as the pictures are concerned, when the FBI raided Trumps residence they kicked everyone out. They got a pile of top secret documents, dumped them all over the floor, took photos of them and gave the photos to the media. Obviously a staged attempt to make Trump look bad. Who can say that they did not stage the bathroom photos as well? They certainly had the opportunity and they displayed a pattern of similar behavior with the other photos.

One thing you might not have noticed is that Trump was not charged with any crimes relating to the documents he voluntarily returned to the government. In other words, if he'd just returned the documents, he wouldn't be going to court today.

Yes, it was ilegal for him to take them even though he was head of state, but if there was no intent to take them, the authorities have always shown leniency. It's the same for everyone at that level.

Trump clearly took documents on purpose, which would have been forgiven had he returned all of them. Instead, he refused to return all of them, hid many from his own lawyers and the FBI, and mishandled them by keeping them in insecure places like his office, a ballroom, etc., and showing or describing them to people, including journalists who were recording the conversation.

Of course, it's problematic that the judge initially assigned to the case is the one who was rebuked by an appeals court and told to stop interfering on Trump's behalf beyond her authority at an earlier stage of the same case.
