So you buy a luxurious smart car and crash it into the side of a building. Who is liable?  You? State Farm insurance? Wells Fargo bank? (for lending you the money for the car)

Liability is not strictly imposed in a situation such as this. The fact that you own a car does not mean that you are liable for any accident involving that vehicle. In situations such as this, liability is only imposed if a defendant was negligent. That requires proof that

1. the defendant had a duty to take some action for the protection of others,
2. the defendant breached that duty,
3. the breach of a duty was a direct and proximate cause of the accident, and
4. the plaintiff suffered damages as a result of the defendant's breach of duty.

Example:

1. Defendant has a duty to observe traffic signals and control his vehicle in accordance with those signals.
2. Defendant failed to observe that the traffic light turned red and entered the intersection when he should have stopped before the intersection.
3. After entering the intersection, Defendant's vehicle collided with plaintiff's vehicle.
4. As a result of the collision, Plaintiff suffered a concussion and a fractured right

State Farm did not cause the accident by providing you with insurance coverage but if they are your insurer, they may be responsible to the injured plaintiff IF there is proof that you were negligent and that caused the injuries.

Ford Motor Credit did not cause the accident by financing the car for you, and they are not your insurer, so they have absolutely no liability in this case and it would be frivolous to even file suit against them.

Accident does go to insurance company.

Accident, can be the cause from incoming vehicle that you were deflected to towards a building. Also not just car crash. Also defective vehicles, that part Does go under A heavy review. That could lead to lawn suit on vehícle the manufacturer.

Intentionally, is to go straight to the building without any cause.

My question why go against the banks? Example, a vehicle has passed the federal requirements. Then manufacturer request a loan to build the cars. Sets them for sale in car dealerships. They a have test vehicle for customers. If they feel comfortable they make the purchase of the new vehicle under manufacturer warranty.

So why hold responsible on banks when literally vehícle manufacturer carries warranty. Who is responsible when a vehicle has a defectiveness?

If the customer decides to break the warranty by taking it to unauthorized dealership or to a local mechanic not certified. Who is responsible?

Banks should be ruled out.

Speaking about the pipelines who gave the green light? I believe you must go to the city and get approved for any construction is going to be made and used the materials that is approved. Now if the company decided to replace and used a different material then who is responsible? The banks will review based on the documents and review city approvals to pass the loan. 🤷‍♂️.

the person driving has sole responsibility or shouldn't be driving. the bank does nothing more then make loans they aren't driving they have no liability with someone who has an accident etc. thats like saying a bank loaned a person money for a restaurant and it failed and closed its not the banks fault or responsibility

Be grateful you had an opportunity to drive and working on your driving skills. The person that crashed the car is OBVIOUSLY the common denominator in this situation. If you're driving and no other vehicles are involved then unless the car was defective its the driver's fault, not the bank's.
