If they have no insurance then there is nothing to claim against, and nothing for them to be indebted over. Hence way it's the insured parties premiums that go up.
But in most countries laws, there will be a "lean" against that person if they were to get into some big cash some time in the future.
But the question is irrelevant, as there are many different legal mitigating circumstances in many different countries.

The answer in my opinion, is to just have "No Fault Insurance." Get it if you want. Because now there's insurance to cover you if the uninsured guy sues you for an accident he caused.
